Terms of Service

1. The Service

Kelvyr is an AI-powered platform that helps businesses generate, schedule, and publish social media content. The Service includes brand analysis, AI image and caption generation, design templates, scheduling, and integrations with third-party social platforms (Instagram, Facebook, X/Twitter, LinkedIn, TikTok, YouTube).

2. Eligibility & Account

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Subscriptions, Credits & Billing

The Service is offered on a free tier and on paid subscription plans (Starter, Growth, Scale) billed monthly or yearly. AI generation consumes “credits”. Subscription plans include a monthly allowance of credits; additional credits can be purchased as needed.

Payments are processed by our payment provider Creem. By subscribing, you authorize Creem to charge your payment method on a recurring basis until you cancel. Prices are listed on our pricing page and may change with prior notice; existing paid periods are honored at the original price.

Subscription credits expire at the end of each billing period. Separately purchased credits do not expire while your account is active. Refund eligibility is described in our Refund Policy.

4. Cancellation & Auto-Renewal

You may cancel your subscription at any time from your dashboard. Cancellation stops future renewals; you retain access until the end of the current paid period. We do not provide pro-rata refunds for unused time outside of the conditions described in the Refund Policy.

5. Your Content

You retain ownership of the brand information, images, and text you submit (“User Content”). You grant Kelvyr a worldwide, non-exclusive, royalty-free license to host, process, display, and transform your User Content solely for the purpose of operating and improving the Service.

6. AI-Generated Output

AI-generated content (images, captions, hashtags) is produced by machine learning models. We do not guarantee that such output is unique, accurate, free of bias, or non-infringing. You are responsible for reviewing all AI output before publishing it to third-party platforms or to the public.

7. Third-Party Integrations

When you connect a third-party social account, you authorize Kelvyr to access and act on your behalf on that account within the scope you approve. Use of those platforms is subject to their own terms. Kelvyr is not responsible for changes, downtime, or content policy enforcement by third-party platforms.

8. Acceptable Use

You agree to follow our Acceptable Use Policy. Violation may result in suspension or termination of your account without refund.

9. Intellectual Property

Kelvyr, its logo, brand, software, and underlying technology are owned by Kelvyr and protected by intellectual property laws. Nothing in these Terms transfers ownership of the Service or its components to you.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted operation or that outputs will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, Kelvyr's total aggregate liability arising from or related to the Service is limited to the amount you paid to Kelvyr in the twelve (12) months preceding the event giving rise to the claim. Kelvyr is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities.

12. Indemnification

You agree to indemnify and hold Kelvyr harmless from any claim or demand arising from your User Content, your use of the Service, or your violation of these Terms or any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for material breach of these Terms, fraud, abuse, or threat to the integrity of the Service. Upon termination, your right to use the Service ends immediately; certain provisions (IP, disclaimers, liability, indemnification, governing law) survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or via the Service. Continued use after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of laws principles. Any dispute shall be resolved exclusively in the courts of Istanbul, Turkey, unless mandatory consumer protection law of your country of residence provides otherwise.
